The Company follows a standard procedure of using log files which logs visitors when they visit the Website. All hosting companies do this as a part of hosting services’ analytics. When You use the Website, We may automatically collect and store certain information including but not limited to internet protocol (IP) addresses, browser type and language, internet service provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. Welcome to the Posture Analyzer application (“App”). By accessing or using this App, you agree to be bound by the terms and conditions outlined below.

1. License & Authorized Use

• The Sleep Company (“Company”) grants a limited, non-exclusive, non-transferable, revocable license to use this App solely for authorized business purposes.
• This App may only be accessed and used on Company-issued devices deployed at officially designated and registered Company-owned flagship stores.
• Any use outside these authorized locations or devices is strictly prohibited.

2. Permitted Use

• The App is intended solely for assisting store personnel in providing mattress recommendations to customers based on posture analysis.
• Outputs generated by the App must only be used as a decision-support tool for in-store customer experience.

3. Restrictions

You agree that you will not:

• Install, copy, or use the App on any personal or unauthorized device.
• Share, distribute, sublicense, or make the App available to any third party, whether inside or outside the Company.
• Modify, decompile, reverse engineer, disassemble, or attempt to derive the source code or circumvent, disable, interfere with, or otherwise compromise any security, authentication, licensing, or access-control mechanism of the App.
• Assist, facilitate, or enable any other person to perform any of the prohibited actions listed above.

4. Device & Access Control

• The App may only be accessed through authorized Company-managed tablet devices.
• The Company reserves the right to restrict, suspend, or revoke access at any time in the event of misuse or policy violation.
• The Company may monitor, log, audit and review usage of the App for security, compliance, operational and training purposes.

5. Health & Medical Disclaimer

• The App provides non-clinical, informational guidance based on posture analysis to assist in mattress selection.
• It is not a medical device and does not provide medical diagnosis, treatment, or advice.
• Customers should consult a qualified healthcare professional for any medical concerns or conditions.
• The Company disclaims all liability for any reliance placed on App outputs for medical or clinical purposes.

6. Intellectual Property

• All rights, title, and interest in and to the App, including its software, design, algorithms, and content, remain the exclusive property of The Sleep Company including all updates, enhancements, modifications, databases, reports, recommendations, analytics, trade secrets, trademarks and other intellectual property rights therein.
• No rights are transferred to the user other than the limited license explicitly granted under this Agreement.

7. Confidentiality

• The App and its underlying systems constitute confidential and proprietary information of the Company.
• Users agree not to disclose, reproduce, or discuss any non-public aspects of the App or its functionality outside authorized business use including its software architecture, algorithms, reports, outputs, workflows, user interface, technical specifications and business processes.

8. Termination

• This license may be suspended or terminated immediately by the Company in case of breach of these terms.
• Upon termination, all access to the App must cease immediately.

Privacy Agreement

The Sleep Company (“Company”, “we”, “us”, or “our”) is committed to protecting the privacy and confidentiality of individuals whose data is processed through the Posture Analyzer application (“App”). This Privacy Policy explains how we collect, use, and safeguard personal information in connection with providing mattress recommendations.

1. Information We Collect

When a customer undergoes posture analysis through the App, we may collect the following information solely for the purpose of generating a mattress recommendation:

• Physical attributes such as height and weight
• Posture-related inputs and back/mattress-related concerns
• Image data captured temporarily for posture analysis processing and not retained after completion of such processing.

2. Purpose of Data Use

The information collected is used exclusively to:

• Generate a posture score
• Analyze posture alignment and related attributes
• Provide mattress recommendations intended to improve sleep comfort and ergonomics

No information is used for unrelated purposes.

3. Data Storage & Retention

• The App does not permanently store customer images. Images are processed only for real-time posture analysis and are discarded immediately after processing.
• Other collected inputs are not used to build long-term personal profiles unless explicitly required for operational reporting in anonymized form.

4. Data Sharing

• We do not sell, rent, or trade personal data to any third parties.
• Personal data is not shared with external entities except where required by law or regulatory authority.

5. Data Security

We implement appropriate technical and organizational safeguards to protect data from unauthorized access, misuse, or disclosure.

6. Consent

• The App is designed solely to provide detailed information about the construction, materials, and layers of mattresses offered by The Sleep Company (“Company”).
• It serves as an in-store educational and sales support tool to help store personnel explain product features to customers.

2. License & Authorized Use

• The Company grants a limited, non-exclusive, non-transferable, revocable license to use the App strictly for internal business purposes.
• The App may only be accessed on Company-issued and Company-managed tablet devices located within officially authorized Company retail stores.
• Any use outside authorized devices or locations is strictly prohibited.

• This App does not collect, store, process, or transmit any personal data of customers or users.
• No customer images, contact details, or sensitive information are captured or retained by this App.
• The App operates entirely as a product information and visualization tool.

6. Intellectual Property

• All content within the App, including but not limited to mattress structures, diagrams, text, visuals, and software components, remains the exclusive property of The Sleep Company including all updates, enhancements, designs, illustrations, animations, visualisations, product representations, trademarks and associated intellectual property rights.
• No rights or ownership are transferred to the user other than the limited license granted herein.

7. Confidentiality

• The App and its internal content are proprietary and confidential to The Sleep Company.
• Users agree not to disclose, reproduce, or distribute any non-public information contained within the App outside of authorized business use whether in physical, electronic, photographic, video, screenshot or any other form..

8. Termination

• The Company reserves the right to terminate or suspend access to the App at any time without prior notice in case of violation of these terms.
• Upon termination, all access to the App must cease immediately.

This Website is not intended for use by minors, and thus the Company does not knowingly collect any Personal Identifiable Information from minors. If You think that a minor has provided this kind of information on Our Website, We strongly encourage You to contact Us immediately and We will do Our best efforts to promptly remove such information from Our records.
